Arizona Gov. Napolitano Vetoes Medical Malpractice Bill
Arizona Gov. Janet Napolitano (D) on Tuesday vetoed a bill (HB 2315) that would have made medical malpractice suits against emergency department physicians more difficult for plaintiffs to win, the Arizona Daily Star reports. The bill would have called for patients to prove by "clear and convincing evidence" that the care provided by physicians did not meet professional standards (Fischer, Arizona Daily Star, 5/3). Currently, plaintiffs have to show a preponderance of evidence. In her veto letter, Napolitano said that in addition to possibly being unconstitutional, there was a lack of evidence that the legislation would have relieved the shortage of ED doctors in the state. Opponents of the bill, which included trial lawyers, said that it would have penalized injured patients, while supporters said it would have encouraged doctors to work in the ED, the Arizona Republic reports. Napolitano said that on Tuesday she signed an executive order to establish a task force that will study access to emergency care (Scutari, Arizona Republic, 5/3).
