Lawyers Submit Final Arguments in Pennsylvania Medicaid Access-To-Care Lawsuit

Lawyers recently submitted final written arguments in a class-action lawsuit against Pennsylvania in which advocates for Medicaid beneficiaries with disabilities allege that access to dental care is inadequate, the... Pittsburgh Post-Gazette reports. Similar lawsuits have been filed in more than 20 states. In the Pennsylvania lawsuit, filed in 2000, attorney Edmond Tiryak and lawyers for the Disabilities Law Project claim that Medicaid-funded dental payments are "grossly inadequate" to ensure access to care for adults and children with disabilities. The suit argues that the state Department of Public Welfare must increase payment rates to dentists to improve access to care. Michael Cerveris, a dentist and leader of a Pennsylvania Dental Association task force examining access to dental care, said that other factors preventing dentists' participation in Medicaid include high cancellation rates among patients and a shortage of dentists in some communities, particularly in rural areas. In court papers, state attorneys argue that the department has taken action to improve access to Medicaid-funded dental care, including raising reimbursement rates in 1999 and 2001. The state also plans this month to increase rates for dental-related anesthesia and behavioral management, according to Stefani Pashman, an assistant to department secretary Estelle Richman. In addition, there are no proposed cuts for dental services in the proposed state budget, Pashman said (Fahy, Pittsburgh Post-Gazette, 7/5).
