Sens. Leahy, Schumer Say Confirming Roberts Will Be Difficult Unless He Publicly States Views on Past Cases, Including Roe

Senators Patrick Leahy (D-Vt) and Charles Schumer (D-NY) on Wednesday said confirming Supreme Court nominee Judge John Roberts will be difficult unless he publicly states his views on past court cases, including... Roe v. Wade, the 1973 Supreme Court case that struck down state abortion bans, the Washington Times reports. Leahy, the ranking Democrat on the Senate Judiciary Committee, said Roberts likely will not be confirmed unless he agrees that Roe is "settled law" (Hurt, Washington Times, 7/28). Leahy also said he would oppose Roberts' confirmation if Roberts appeared to be an antiabortion advocate seeking to overturn Roe (Long Island Newsday, 7/28). Schumer said he expects Roberts to discuss his views on the Roe decision and aims to determine if Roberts is an "ideologue" who will allow his personal views to influence his legal decisions, according to the New York Times (Hernandez, New York Times, 7/28). Although little is known about Roberts' views on abortion, some observers say he could tip the balance of the Supreme Court on the issue because retiring Justice Sandra Day O'Connor was the deciding vote in several cases that upheld abortion rights. Although Roberts, who in 2003 was confirmed as a judge for the U.S. Court of Appeals for the District of Columbia, has never written a legal opinion on the issue as a judge, he has argued as an attorney in several abortion-related cases. During his 2003 confirmation hearings for the federal judgeship, Roberts said the decision in Roe is "the settled law of the land" (Kaiser Daily Reproductive Health Report, 7/27). Other Coverage

"Media war over nominee still just a rumble," USA Today: Although advocacy groups expected to battle over a Supreme Court nomination, the media campaign has been "muted" because President Bush's choice of Roberts "has so far taken much of the air out of the expected public relations fight," according to USA Today (Memmott, USA Today, 7/28).

"On Question of Nominee Questions, No Clear Answer," Washington Post: The Post on Thursday examined the discussion among Democrats and Republicans as to what questions are appropriate for senators to ask Roberts during his confirmation hearings, including questions regarding his views on Roe, and how the subject of abortion rights has been handled in past confirmation hearings for Supreme Court nominees (Babington, Washington Post, 7/28).

"Kennedy One To Watch on Abortion," Women's eNews: In addition to monitoring Roberts' views on abortion-related issues, abortion-rights supporters in upcoming Supreme Court cases also will watch Justice Anthony Kennedy, who has "mixed views" on abortion, according to Women's eNews (Cooper, Women's eNews, 7/26).

NPR's "Morning Edition" on Thursday reported discussions for setting a date for Roberts' confirmation hearings. The segment includes comments from Sens.
