Alito Has History Of Opposing Abortion Rights, Some Democrats Say During Full Senate Debate

Some Democrats during full Senate debate on the confirmation of Supreme Court nominee Judge Samuel Alito on Wednesday said Alito has a history of opposing a woman's right to abortion, NPR's "All Things Considered" reports (Welna, "All Things Considered," NPR, 1/25). President Bush in October 2005 nominated Alito to replace retiring Supreme Court Justice Sandra Day O'Connor, who has said she will remain on the court until her successor is confirmed. Alito during the committee hearings earlier this month said his statement in a 1985 job application to become deputy assistant to former Attorney General Edwin Meese that he "personally believes very strongly" that "the Constitution does not protect a right to an abortion" was a "true expression" of his "views at the time." However, he added that long-standing Supreme Court decisions deserve respect and that he would approach abortion-rights cases "with an open mind." The Senate Judiciary Committee on Tuesday voted to recommend Alito for confirmation by the full Senate (Kaiser Daily Women's Health Policy Report, 1/25). Sen. Richard Durbin (D-Ill.) said senators have a "special responsibility" because the vacancy Alito would fill by replacing O'Connor -- who provided a "decisive vote" on cases involving privacy and reproductive rights -- "will tip the scales of justice in America one way or the other way." Senate Judiciary Committee Chair Arlen Specter (R-Pa.), who supports abortion rights, said, "No one knows with certainty how Judge Alito is going to vote," noting that O'Connor was "very much opposed to abortion rights before she came to the court, and she has been one of the foremost proponents of a woman's right to choose." The NPR segment also includes comments from Bush, Senate Majority Leader Bill Frist (R-Tenn.), Senate Minority Leader Harry Reid (D-Nev.) and Sens. George Allen (R-Va.), Edward Kennedy (D-Mass.) and Patrick Leahy (D-Vt.) ("All Things Considered," NPR, 1/25).
