Assistant U.S. Attorney Seeks To Establish Rules For Federal Trial Of Convicted Murderer Kopp

Assistant U.S. Attorney Kathleen Mehltretter through multiple pretrial motions is seeking to establish rules in convicted murderer James Kopp's upcoming federal trial involving charges related to the murder of Buffalo, N.Y., abortion provider Barnett Slepian, the AP/Long Island Newsday reports (Thompson, AP/Long Island Newsday, 7/17). Kopp in 2003 was convicted under state second-degree murder charges and sentenced to 25 years to life in prison for murdering Slepian in 1998. In the upcoming trial, he faces charges of violating the federal Freedom of Access to Clinic Entrances Act. The federal charges could carry a sentence of life in prison without parole. Kopp's former attorney, John Humann, had filed a motion to suppress Kopp's confession to the murder despite Kopp's objection. Kopp subsequently made a request to represent himself, which U.S. District Judge Richard Arcara granted in May (Kaiser Daily Women's Health Policy Report, 5/25). According to AP/Newsday, prosecutors have asked Arcara to prohibit buttons or T-shirts displaying abortion-related slogans in the courtroom. They also are trying to prevent Kopp from explaining his reasons for opposing abortions, describing the experiences of former abortion patients and how fetuses develop or showing the jury pictures of aborted fetuses, AP/Newsday reports. Mehltretter also is attempting to exclude public statements made by Kopp during a 2002 Buffalo News interview and limit witnesses from describing Kopp as a "good person, sincere person, spiritual or holy person, religiously devoted, or good sibling," AP/Newsday reports. Arcara on Monday tentatively scheduled the federal trial to begin Jan. 3, 2007 (AP/Long Island Newsday, 7/17).
