Federal Judge Calls For Hearing About Circumstances Surrounding The James Kopp Confession Of Killing Abortion Provider, USA

A federal judge on Friday called for a hearing to review the circumstances surrounding James Kopp's confession of killing Buffalo, N.Y., abortion provider Barnett Slepian, the AP/Long Island Newsday reports (Thompson, AP/Long Island Newsday, 12/9). Kopp was convicted in 2003 under state second-degree murder charges after he admitted he shot Slepian in October 1998. He currently is serving 25 years to life in prison (Kaiser Daily Women's Health Policy Report, 6/21). Kopp's attorney, John Humann, on Friday told U.S. District Judge Richard Arcara that Bruce Barket, Kopp's former attorney, advised Kopp to confess to the shooting in order to win leniency for his other client, Loretta Marra, who served two years in prison for helping Kopp escape authorities after the shooting. "Barket was throwing my client under the train to help his other client," Humann said. Humann is seeking to have Kopp's confession stricken from the record in his upcoming federal trial on related charges of violating the Freedom of Access to Clinic Entrances Act (AP/Long Island Newsday, 12/9). If convicted on the federal charges, which include a charge that he violated a statute that bars forceful interference with reproductive health service providers, Kopp could be sentenced to life in prison without the possibility of parole. Kopp, who is a member of the antiabortion group Army of God, also has been charged with the federal crime of using a firearm to commit a crime of violence. In April, Magistrate Judge Hugh Scott of the Federal District Court in Buffalo recommended that Kopp's motion to dismiss the federal charges be denied. Arcara can accept or reject the recommendation (Kaiser Daily Women's Health Policy Report, 6/21). Arguments
Government prosecutor Kathleen Mehltretter said that she and Barket had discussed leniency for Marra prior to Kopp's confession, adding that they never came to an agreement. Barket on Friday said that a state judge had allowed him to represent Kopp and Marra at the same time, but a federal magistrate had denied them the same arrangement. He said that no written deal regarding leniency for Marra was reached with prosecutors but that "there was clearly an understanding," adding Kopp's confession was released prematurely by reporters and the deal "did not go as ... planned." Mehltretter said that the confession should be allowed in the federal trial because it was voluntary and "not a governmental interview." Humann said that the statement cannot be considered voluntary if he was advised by an attorney with a conflict of interest. Arcara said that Barkett; Paul Cambria, who also is one of Kopp's former attorneys; Mehltretter; and possibly Marra likely would be called to testify at the hearing. The hearing date will be determined at a conference on Jan. 13, 2006 (AP/Long Island Newsday, 12/9).
