Ill. Lawmakers Approve for Permanent Status Emergency Rule Requiring Pharmacies To Fill Birth Control Prescriptions
The Illinois Joint Committee on Administrative Rules on Tuesday approved making permanent Gov. Rod Blagojevich's (D) emergency rule requiring pharmacies in the state to accept and fill prescriptions for contraceptives, the... Chicago Sun-Times reports. Under the temporary rule -- which went into effect in April -- pharmacies can opt to not sell contraceptives (Pallasch, Chicago Sun-Times, 8/17). However, the rule requires that any pharmacy in the state that sells any FDA-approved contraceptives must fill all prescriptions for approved birth control, including emergency contraception, in a timely manner (Chase, Chicago Tribune, 8/17). If the prescribed contraceptive is out of stock, pharmacies must provide an alternative, order the drug, make arrangements for another local pharmacy to fill the order or return the prescription to the customer (Lannan, AP/ABC7 News, 8/17). The rule also established a toll-free number for state residents to report pharmacies that refuse to fill contraceptive prescriptions, and pharmacies violating the rule risk losing their licenses (Kaiser Daily Reproductive Health Report, 7/27). To become permanent law the rule must be filed with the secretary of state's office, which is expected to take place within the next week. Since the order was issued, six pharmacists have sued the state, saying the rule requires them to violate their moral or religious beliefs (Chicago Tribune, 8/17). Congress is considering legislation similar to Blagojevich's emergency rule, and more than 12 states are considering measures regarding access to contraceptives (Kaiser Daily Reproductive Health Report, 7/27).
