Montgomery County, Md., Council Likely To Approve More Limited Prescription Drug Reimportation Program, USA

Montgomery County, Md., Council President Tom Perez on Tuesday introduced a bill that would require the county to establish a program to allow about 12,500 Montgomery County, Md., employees and retirees to purchase lower-cost prescription drugs from Canada, the Washington Post reports. The bill, which includes six of the nine council members as co-sponsors, likely will pass. Perez said that the legislation could save the county at least $2 million annually in prescription drug costs. The bill is a more limited version of a resolution passed by the council in September 2004 that established a voluntary program to allow 85,000 county employees and retirees to purchase prescription drugs through Canusa, a health benefits company based in Ontario, Canada. According to the Post, the program "suffered a setback" last month when the county school board decided not to participate, "largely because of concerns that the program would violate federal law." The move prompted Perez to introduce the new bill, in part because the council has direct control over the county government. FDA officials have said that prescription drug reimportation programs violate federal law, but, according to Perez and other supporters, the agency to date has not prosecuted local governments that have established such programs. Council member Howard Denis (R), a co-sponsor of the bill, said, "The FDA does not have the courage of its convictions." Perez said, "It's really time for action," adding that "the people are ahead of the politicians" on the issue of prescription drug reimportation (Barr, Washington Post, 10/12).
