Roll Call Examines Response to FTC Study of PBMs, USA

Roll Call on Tuesday examined a study released in September by the Federal Trade Commission that found mail-order pharmacies owned by pharmacy benefit managers provide generally cost-effective prescription drug plans. The National Community Pharmacists Association, which represents drugstores, pushed for the study after expressing concerns about possible conflicts of interest related to PBMs securing contracts for their mail-order pharmacies under the new Medicare prescription drug benefit (Ackley, Roll Call, 10/3). The FTC study, mandated by the 2003 Medicare law, compared the cost of drugs from retail pharmacists, mail-order pharmacies not owned by PBMs and mail-order pharmacies owned by PBMs. FTC found that for large PBMs, average total prices in 2002 and 2003 at PBM-owned mail-order pharmacies typically were lower than at mail-order pharmacies not owned by PBMs (Kaiser Daily Health Policy Report, 9/7). John Rector, senior vice president and general counsel for NCPA, said the report did not address the concerns of community pharmacists, noting that the study examined only PBMs' private sector relationships. He said, "While that might be fine and dandy for the private sector, Medicare has a strong tradition of rejecting self-referrals." Rector said the group likely will file a Freedom of Information Act request "to find out what happened at the FTC because they didn't address the exact question that Congress asked. They sort of punted on the key question." Mark Merritt -- president of the Pharmaceutical Care Management Association, which represents PBMs -- said the study did answer the questions, and it was a "classic case of 'be careful what you ask for'" for NCPA. He added, "We didn't ask for this study, even though in the end it's very helpful to us and our industry." A spokesperson for FTC did not comment (Roll Call, 10/3).
