Frist Seeking To End Debate On Alito Nomination; Some Democratic Senators Plan Filibuster, USA

Senate Majority Leader Bill Frist (R-Tenn.) said he would lead a cloture vote on Monday to limit debate on the Supreme Court nomination of Samuel Alito, and if the required 60 votes are gathered, a confirmation vote will be held on Tuesday, the AP/San Francisco Chronicle reports (Holland, AP/San Francisco Chronicle, 1/26). Meanwhile, Sens. Edward Kennedy (D-Mass.) and John Kerry (D-Mass.) are "breaking ranks" with Democratic leaders by calling for a filibuster of Alito, according to the Boston Globe (Savage/Klein, Boston Globe, 1/27). Other filibuster supporters include Sens. Barbara Boxer (D-Calif.), Debbie Stabenow (D-Mich.) and Paul Sarbanes (D-Md.), as well as Senate Minority Whip Richard Durbin (D-Ill.), the Los Angeles Times reports (Reynolds, Los Angeles Times, 1/27). President Bush in October 2005 nominated Alito to replace retiring Supreme Court Justice Sandra Day O'Connor, who has said she will remain on the court until her successor is confirmed. Alito during the Senate Judiciary Committee hearings earlier this month said his statement in a 1985 job application to become deputy assistant to former Attorney General Edwin Meese that he "personally believes very strongly" that "the Constitution does not protect a right to an abortion" was a "true expression" of his "views at the time." However, he added that long-standing Supreme Court decisions deserve respect and that he would approach abortion-rights cases "with an open mind." The judiciary committee on Tuesday voted to recommend Alito for confirmation by the full Senate. Some Democrats during full Senate debate, which began on Wednesday, said Alito has a history of opposing a woman's right to abortion (Kaiser Daily Women's Health Policy Report, 1/26). Senate Minority Leader Harry Reid (D-Nev.) and Durbin on Thursday said Senate Democrats likely will not filibuster the nomination, which would require votes from 41 senators to sustain, the Boston Globe reports (Boston Globe, 1/27). Thirty-one Democratic senators and one independent, Sen. Jim Jeffords (Vt.), have announced their opposition to Alito's confirmation (AP/San Francisco Chronicle, 1/26). It is not yet clear how many of those in opposition to his confirmation would agree to try to prevent a final vote, CQ Today reports (Stern/Perine, CQ Today, 1/26). Reaction
Kennedy said the filibuster effort is "an uphill climb at this point, [b]ut it is achievable" (Kirkpatrick, New York Times, 1/27). Reid on Thursday did not join in the call for a filibuster, saying, "No one can claim in this matter that there hadn't been time to talk about Judge Alito ... [a]nd I express my appreciation to (Frist) for giving everyone adequate time to talk" (Los Angeles Times, 1/27). Sen. John Cornyn (R-Tex.) in a statement said, "Continuing to threaten a filibuster, even after it is crystal clear that Democrats don't have the necessary votes to sustain their obstruction, is needless, strange and at odds with many of their fellow Democrats" (Babington, Washington Post, 1/27).


NPR's "Day to Day" on Thursday reported on some Democrats' concerns over Alito's position on abortion rights. The segment includes comments from Bush; Sens. Dianne Feinstein (D-Calif.) and Lisa Murkowski (R-Alaska); and judiciary committee chair Sen. Arlen Specter (R-Pa.), who supports abortion rights (Welna, "Day to Day," NPR, 1/26).
